Statement of Approach on Compliance

The Commission’s Statement of Approach on Compliance outlines the Commission’s compliance program for monitoring compliance with electricity laws, rules, and regulations. The Statement of Approach on Compliance contains the Commission’s risk assessment methodology, monitoring and reporting mechanisms, and enforcement options in response to regulatory breaches.

The Commission’s Statement of Approach on Compliance is applicable to all regulated entities (including Independent Power Producers), and is intended to supplement a regulated entities’ compliance process or framework to ensure compliance with the regulatory framework.

Guaranteed Service Level Code

The Utilities Commission has made a Guaranteed Service Level Code to set out the arrangements for payments by an electricity network service provider to small customers who have received a very poor level of service.

The Code is based on the recommendations arising from the Review of Options for Implementation of a Customer Service Incentive Scheme for Northern Territory Electricity Customers and consultation with electricity industry participants. The Commission has also published an explanatory document setting out the reasons and rationale for developing the Code.

Guaranteed Service Level Code

The Commission proposes to make a Guaranteed Service Level Code setting out the arrangements for payments by an electricity network service provider to small customers who have received a very poor level of service. The GSL Code will be made under a new regulation of the Utilities Commission Regulations.

In making a code, the Commission must consult with the Minister, representative bodies and participants in the electricity supply industry [s24(4) of the Utilities Commission Act], and notify the making of the code in the Gazette [s24(8)]. As part of the consultation process, the Commission has developed an explanatory document setting out the reasons and rationale for developing the Code. The Commission conducted a two week consultation on 28 November 2011, with written submissions due by 9 December 2011.

A second draft GSL Code was developed, reflecting the views and comments from submissions. The Commission has decided to conduct a second consultation on the revised draft GSL Code. The scope is limited to asking interested parties whether they have further comments which were not already discussed during the first consultation.

Submissions are due no later than Wednesday 21 December 2011. Late submissions will not be accepted..

Electricity Retail Supply Code - Service Order Procedures

In accordance with section 7.1.1 of the Northern Territory Electricity Retail Supply Code (the Code), the Commission has approved Power and Water Corporation’s (PWC) Service Order Procedures (the Procedures) as received by email on 23 November 2011. The Commission is satisfied that the Procedures meet the minimum requirements set out in the Code and provide a workable basis for retail competition in the Territory. The Commission's approval is subject to conditions.

New Utilities Commissioner

The Treasurer has announced Dr Patrick (Pat) Walsh as the Northern Territory’s new Utilities Commissioner.

As part of a three man commission with Mr Mike Robson and Mr Peter Caldwell, Dr Walsh will continue to put in place a priority works program which the Government has developed to improve the industry’s efficiency as well as standards and reliability of supply for customers

Statement of Approach on Compliance

As part of a comprehensive and robust compliance framework, the Commission is developing a Statement of Approach on Compliance setting out the Commission’s expectations with respect to compliance.

The Commission considers that regulated businesses and interested parties have an active role to play in the development of an effective compliance framework. Their participation, engagement, commitment will play a fundamental role in shaping the compliance framework. The Commission invites stakeholders and interested parties to share their views, experience and knowledge through the consultation process on this Statement of Approach.

The Commission invites interested parties to make written submissions by Monday 19 September 2011.

Review of Electricity System Planning, Monitoring and Reporting
Review of Electricity System Planning and Market Operation Roles and Structures

The Commission has released Draft Reports for the Review of Electricity System Planning, Monitoring and Reporting and the Review of Electricity System Planning and Market Operation Roles and Structures.

The Draft Report - Planning, Monitoring and Reporting provides an overview of planning, reporting and monitoring functions and activities undertaken by electricity suppliers, industry regulators and governments to ensure that power system security and reliability outcomes are in the long term interest of customers. It sets out the Commission's proposed recommendations for a course of action that ensures that planning monitoring and reporting promote acceptable performance outcomes for the Northern Territory.

The Draft Report - Market Operation Roles and Structures provides an overview of system planning and market operation arrangements, including the role and structure of the system control unit of the Power and Water Corporation. It sets out the Commission's proposed recommendations for a course of action that ensures the allocation of functions to do with system planning and market operation promote efficient and reliable electricity system performance.

The Draft Reports have been released together to allow an effective and informed discussion of the allocation of the functions and responsibilities associated with system and market operation and system planning.

The Commission invites interested parties to make written submissions to either or both Draft Reports by Friday 2 September 2011. Final Reports to be presented to the Minister by October 2011.

Electricity Retail Supply Code

The Utilities Commission has made an Electricity Supply Retail Code to set out the rules governing the processes for transferring customers, the obligations of retailers and network providers, retailer of last resort and dispute resolution procedures. The objective of this Code is to document and codify the arrangements that are immediately necessary to support effective business to business interactions and to provide appropriate customer protection.

The Code is based on the extensive initial work by Northern Territory Treasury, including consultation with electricity industry participants. The Commission has also published an explanatory document setting out the reasons and rationale for developing the Code.

Retail Licence issued to QEnergy

The Commission has considered the licence application from QEnergy Pty Ltd for a Retail Electricity Licence in accordance with the requirements set out in s16 of the Electricity Reform Act and is pleased to grant an electricity retail licence to QEnergy.

The Commission has released the Issues Paper for the Review of Electricity System Planning, Monitoring and Reporting.

The Issues Paper provides and overview of planning, reporting and monitoring functions and activities undertaken by electricity suppliers, industry regulators and governments to ensure that power system security and reliability outcomes are in the long term interest of customers, and sets out the Commission's preliminary reviews on possible options for the Northern Territory.

The Commission invites interested parties to make written submissions by Friday 14 January 2011. The terms of reference for the Review require the Final Report to be presented to the Minister by June 2011.

The Treasurer has approved Terms of Reference for the Commission to undertake a review of Full Retail Contestability (FRC) for NT electricity customers.

New Utilities Commissioner

The Treasurer has announced Mr Andrew Reeves as the Northern Territory’s new Utilities Commissioner.

The appointment of Mr Mike Robson and Mr Peter Caldwell as Associate Utilities Commissioners was also announced, as well as a strengthened and expanded role for the Utilities Commission and a priority work program.

Approval of Minimum Standards of Service

Ring-fencing Code

The Commission has agreed to a request from Power and Water for an extension to 30 September 2009 for the finalisation of the related party terms and conditions, a copy of which is required to be provided to the Commission in accordance with clause 3.3(a)(iv) of the Ring-fencing Code.

Technical Breach of Licence

Casuarina Power Outages: Recommendations regarding Guaranteed Service Level (GSL) Payments

The Utilities Commission – as the independent regulator in the NT’s electricity supply industry – has now provided its advice to the Treasurer, as Regulatory Minister, on the nature and level of possible ‘guaranteed service level’ (GSL) payments to customers affected by the power outages.

Review of NT Electricity Ring-fencing Code

The Commission has now finalised revisions to the NT Electricity Ring-fencing Code to take effect from 1 January 2009. The Commission's Statement of Reasons will be released shortly.

The Commission released its “Revised Draft Code” in August 2008. Two submissions were received:

2009 Regulatory Reset

As required by the Final Methodology Decision, Power and Water submitted its ‘initial regulatory proposal’ to the Commission for the third regulatory period covering all of Power and Water’s regulated networks on 22 August 2008.

This Paper presents the Commission’s Draft Determination, based on whether or not it proposes to approve Power and Water’s initial regulatory proposal and, if not, what revisions it proposes to require before a revised regulatory proposal could be approved by the Commission. This Draft Determination reflects the Commission's consideration of issues raised in submissions on the Initial Draft Determination. This Draft Determination is published in conjunction with the recommendations from the Commission's advisers and a revised Po adjustment model.

Power and Water is now required to submit its Revised Regulatory Proposal by Friday, 30 January 2009.

The Commission will then consider whether or not to approve Power and Water's Revised Regulatory Proposal and, if not, will develop the necessary determinations to give effect to an approved set of arrangements to commence on 1 July 2009. The Commission's final decisions and reasoning will be published in its Final Determination to be published by 31 March 2009.

Review of NT Electricity Ring-fencing Code

In August 2008 following receipt of submissions on the May Draft, given that significant matters have been raised, the Commission decided to release a further draft for comment rather than going straight to a final decision.

The Commission has now released a "Revised Draft Code" accompanied by a paper that recapitulates the rationale that lies behind the draft Code and explains the positions that the Commission has taken on the contentious issues. In light of some of these views, the Commission has made some further modifications and refinements to the proposed Draft Code.

The Commission invites submissions from interested parties concerning the Revised Draft Code

A ‘Delta View’ showing the substantive changes between the draft version of the Code now issued for comment compared with the version of the Code currently applying is also provided below.

Certain formatting and consequential changes are not marked up in this document. Interested parties should refer to the original Codes rather than rely on this delta view document.

2009 Regulatory Reset

The Commission has agreed to Power and Water’s request for an extension to the time to lodge submissions on the Commission’s Initial Draft Determination. However, in order to meet its statutory obligations, please note that the Commission will be unable to grant any requests for further extensions as part of the 2009 Reset.

The revised closing date for submissions is Friday, 7 November 2008.

The Commission will publish its Initial Draft Determination, based on whether or not it proposes to approve the initial regulatory proposal and, if not, what revisions it proposes to require before a revised regulatory proposal could be approved by the Commission in early October, at which time the view of interested parties will be sought.

Review of Ring-fencing Code

In May 2008, the Commission published a Proposed Draft Ring-fencing Code, in accordance with clause 7.4 of the Code.

A late submission has now been received from NT Treasury in response to the draft Ring-fencing Code. The Commission has accepted the submission following advice from NT Treasury that the lateness of the submission was due to the calling of the Territory election and caretaker conventions being in operation.

2009 Regulatory Reset

As required by the Commission’s 2009 Regulatory Reset: Final Price Control Mechanism Decision (published in May 2008), the Commission has approved the network services classification proposed by Power and Water for the third regulatory period.

This is an interim approval - the final network services classification for the third regulatory period will form part of the Commission’s 2009 Regulatory Reset: Final Determination to be released in November 2008.

Renewal of Electricity System Control Licence

The Commission has granted an Electricity System Control Licence to the Power and Water Corporation. The System Control Licence issued in June 2005 expired on 30 June 2008.

Review of Ring-fencing Code

Power and Water has requested an extension of one month to lodge its submission on the Draft Ring-fencing Code in order to have sufficient time to obtain and consider expert legal advice.

The Commission has agreed to the one month extension requested. This should be sufficient time for Power and Water to identify the main legal and regulatory issues which it considers necessary to raise with the Commission. While the Commission is unlikely to agree to further extensions, the Commission will nevertheless be ensuring that there is sufficient time to fully consider all further amendments proposed to the Code – including in response to Power and Water’s detailed consideration of the issues this time around.

While this will cause the proposed start date of 1 September 2008 for the new Code to slip, at this stage the Commission will not nominate a revised start date.

The revised closing date for submissions on the Draft Code is 25 July 2008.

Review of NT Electricity Ring-fencing Code

In February 2008, the Commission published a Proposed Variations Paper, in accordance with clause 7.1 of the Code, which sets out the nature of the proposed changes to the Code.

Following consideration of submissions from interested parties and its own further deliberations in consultation with its legal advisers, the Commission has decided to proceed with the proposed variations to the Code, although with some modification to the specific drafting detail set out in the earlier Consultation Paper, mainly in response to submissions received.

The Commission has now released its “Proposed Draft Code”. Submissions are invited from interested parties concerning the issues raised in this Proposed Draft Code paper and related matters.

The closing date for submissions is Friday, 27 June 2008.

A ‘Delta View’ showing the substantive changes between the version of the proposed Draft Code that accompanied the Proposed Variations Paper and the Draft Code now proposed is also provided below.

2009 Regulatory Reset

Following the publication of its Final Decision on price control mechanism issues, the Commission has now published its Po adjustment model. The Commission’s Po adjustment model sets out the manner in which Power and Water’s efficient costs of supplying standard control services in a single regulatory year are to be calculated. As part of its regulatory proposal, Power and Water must submit to the Commission a proposed Po adjustment factor calculated using the Commission’s Po adjustment model.

Power and Water (and other stakeholders) may request corrections and modifications to the Po adjustment model issued by the Commission where this is considered necessary to achieve consistency with the applicable provisions of the National Electricity Rules or of the NT Electricity Networks (Third Party Access) Code. Requests for corrections or modifications must be lodged with the Commission by no later than Monday, 30 June 2008. The Commission will publish its response to each request for correction or modification within five business days of receipt of the request.

The Commission’s Po adjustment model should be used in conjunction with the Commission’s Final Decision on the price control mechanism to apply during the third regulatory period.

Technical breach of licence

Power and Water is required to undertake an audit of all or part of the operations authorised by relevent licences in respect of each financial year and its compliance with the obligations under the relevent licence and associated regulatory instruments, which must be conducted by an independent auditor.

The Commission has noted that certain areas of non-compliance continue to be identified by the audit from year to year

Accordingly, the Commission considers Power and Water to be in technical breach of the relevant licences and will remain so until such time as each of the non compliance areas are rectified.

Possible Review of Certain Regulatory Instruments

2009 Regulatory Reset

In the lead-up to the commencement of the third regulatory control period (the five year period commencing 1 July 2009), the Code requires the Commission as regulator - in consultation with interested parties - to review the network price regulation methodology used in the second regulatory control period with a view to modifying the methodology as appropriate. The Commission is referring to this process of establishing the network price regulation methodology to apply from 1 July 2009 as the "2009 Regulatory Reset".

Possible Review of Certain Regulatory Instruments

The Commission has taken an in-principle decision to - over the next year or so - revamp the NT electricity ring-fencing code and develop some contestable pricing guidelines, notwithstanding regulatory policy developments that may impact on the NT's electricity market over the same period.

An Issues Paper has been released setting out the Commission's reasoning for this preferred course of action, in order to obtain stakeholder feedback. The Commission will take views received into account before deciding whether or how to proceed.

Licence Exemption for Small Scale Renewable Operations

The Commission, with the approval of the Minister, has issued an exemption from the requirement for generation and retail licences for installations defined as small scale renewable energy operations.

The Commission does not consider it appropriate that such small scale renewable energy operations be subject to the same licensing requirements as apply to larger electricity entities. These operations are generally not for profit, the majority of electricity generated is for private use, the amount transferred back into the grid is very small and the risk to the power system security is small.

Contestable Pricing Guidelines

In September 2001, the Commission published Contestable Pricing Guidelines to present the Commission’s views on the types of pricing conduct that could give rise to a finding of ‘anti-competitive’ and/or ‘discriminatory’ conduct by the Commission under either the Ring-Fencing Code or the complaints provisions of the Electricity Reform Act 2000. 

In the circumstances that currently prevail in the NT electricity market, the Commission has decided that the Guidelines are in need of review. To allow time for such a review to take place, the Commission has withdrawn the Guidelines with immediate effect from 26 April 2007.

The Commission has released an Energy Loss Factors Code. This Code sets out the high-level principles underlying the calculation of energy loss factors. Complaint Investigation

Application for an electricity retail licence refused

The Commission has not received the assurances sought regarding the financial capacity of Paladin Torrix Energy Corporation Pty Ltd (PTEC) to operate as an electricity retailer within the requisite timeframe. Accordingly, on 4 January 2005, the Commission advised PTEC of its decision to refuse to grant the requested licence.

 

The Commission has not been able to satisfy itself, as required under section 16(2)(d) of the Electricity Reform Act 2000, that PTEC would be able to meet reasonably foreseeable obligations for the sale of electricity. The Act only permits the Commission to grant a retail licence where it is satisfied that an applicant is able to meet reasonably foreseeable obligations for the sale of electricity.

 

The Commission will only re-open PTEC’s application when and if PTEC is able to provide the Commission with the requested information about its financial capacity to operate as an electricity retailer.

Retail prices paid for electricity by contestable customers is a matter for negotiation between each customer and licensed retailers.
