Bilateral Agreement
The Northern Territory Government and the Australian Government have a bilateral agreement on the management of the environmental assessment of a proposal that requires formal assessment under both the Northern Territory and Australian governments’ respective legislation. Under the bilateral agreement, the assessment undertaken by the Northern Territory is taken to fulfil the requirements of the EPBC Act.
The bilateral covers only the assessment process. The Australian Government’s Minister retains approval powers for each project.
