The Building Appeals Board

The Building Appeals Board is a statutory body established by the Building Act and is responsible to determine:

  • modifications to the application of building regulations ;
  • appeal by the owner or agent against the decision of a Building Certifier;
  • appeal by the Director against the decision of a Building Certifier; and
  • appeal against the Director when acting in the capacity of a Building Certifier.

Applications to Vary Setbacks

Since February 2007, applications to vary the setback provisions for single dwellings, carports, verandas etc in areas zoned by the NT Planning Scheme (Darwin, Palmerston, Litchfield Shire, Batchelor, Katherine, Borroloola, Alice Springs and Tennant Creek) are determined by the Development Consent Authority (DCA). Applications to the DCA can be made via an Application for Development Permit which can be downloaded from the DCA website.

Setback requirements for sheds associated with existing single dwellings are still covered by the Building Regulations and determined by the Building Appeals Board. Applications to the Appeals Board should be lodged by an application for modification of setback requirements.

In gazetted building areas where the NT Planning Scheme does not apply (ie land is not zoned) the Building Regulations continue to apply (Adelaide River, Timber Creek and the like) and application to vary these should be made to the Building Appeals Board, using the application for modification of setback requirements.

Meetings

The Building Appeals Board meets only when the Board has applications to determine.
