In the Northern Territory the rights of Aboriginals in places and objects of cultural significance are given specific protection of legislation:
The Heritage Conservation Act 1991 which protects "portable cultural objects" including stone tools, human bones and rock art.
Before giving approval to any persons to fossick on a pastoral lease, pastoral lessees should make fossickers aware of the following:
"Fossickers may not remove, alter or damage any Aboriginal artifacts (including stone tools, rock art etc)
Fossickers may not work within the area of a sacred site unless specific approval is given (in the form of a certificate issued under Section 22 of the Northern Territory Aboriginal Sacred Sites Act).
