Site Avoidance through Authority Certificates

   People proposing to use or work on land may apply to the Authority for an Authority Certificate to cover their proposed activities.  The Authority will respond to an application by consulting the relevant Aboriginal custodians within 60 days to ascertain whether a Certificate can be issued and any conditions needed to protect any sacred sites that might be affected by the proposed works.

Legally, an Authority Certificate provides a defence against possible prosecution for in relation to the works or uses covered by the Certificate as long any conditions imposed to protect sacred sites are followed.

Also, the process can offer the opportunity for applicants to meet with custodians to reach a mutually acceptable resolution of any sacred site issues, so that the end result reflects the agreement of the people directly involved.
