Aboriginal Sacred Site Protection in the Northern Territory

The Northern Territory Aboriginal Sacred Sites Act (No. 29 of 1989) is substantially based on the Aboriginal Sacred Sites Act (No. 116 of 1978).  Both were enacted by the Northern Territory Legislative Assembly pursuant to Section 73(1) of the Commonwealth Aboriginal Land Rights (Northern Territory) Act 1976.  The Aboriginal Land Rights Act provides key definitions for the Northern Territory Aboriginal Sacred Sites Act:

Sacred sites include sites of significance:

...a site that is sacred to Aboriginals or is otherwise of significance to Aboriginals according to Aboriginal tradition ...

Aboriginal tradition is defined as:

... the body of traditions, observances, customs and beliefs of Aboriginals or of a community or group of Aboriginals, and includes those traditions, observances, customs and beliefs as applied in relation to particular persons, sites, areas of land, things or relationships ...

The Aboriginal Areas Protection Authority, through the majority (10 of 12) membership of senior Aboriginal site custodians, and through consultations with site custodians for particular purpose, principally for Authority Certificates, is constituted to decide matters of site definition and Aboriginal tradition for the purposes of the Act.

The Authority also maintains the Register of Sacred Sites.
